    ملخص : من واقع ماأفرزته التكنولوجيا الرقمية المشفرة على العالم أجمع ،ورقة ساتشي ناكاموتو التي وصف فيها النقد الإلكتروني المشفر كبديل للنقود التقليدية بغرض إلغاء الوسيط أو الطرف الثالث بين المتعاملين و أنتجت البتكوين بطريق التعدين ، ثم إجتاحت الأسواق المالية ومنصات التداول الإلكترونية للمضاربة بها من أجل الربح مقابل فارق السعر ، كما إستنسخت على شاكلتها بتقنية البلوكتشين الآلاف من العملات المشفرة ، فأصبحت الأصول المالية من أجل المضاربة بها ، وهذه الدراسة تتمحور حول التكييف الشرعي لها ولإصدارعا والتعامل بها وبالضبط العملة الأم (البتكوين ) ،دراسة فقهية تأصيلية وضبطها بقواعد فقهية أصولية بذكر النصوص والشواهد والأدلة ومراعاة لمقاصد الشارع ، وصولا إلى الحكم الشرعي لها. Abtract The Technology of digital currencies led to change the whole word and the new financial system brought by Satoshi Nakamoto, in which he described electronic crypto cash as an alternative to traditional money in order to cancel the intermediary or third party between dealers, and produced bitcoin by mining, and then swept the financial markets and electronic trading platforms it has become a financial asset in order to speculate, and Blockchain technology has also been used to make a lot of Cryptocurrencies, and this study is centered on legal adaptation of it and to issue and deal with it and exactly the mother currency (bitcoin), study of jurisprudence authentic, and adjust them to the rules of jurisprudence, fundamentalism, mentioning texts, evidence and taking into account the purposes of the street, up to the rule of sharia her.
