    القرار الإداري المنعدم

    يعتبر القرار الإداري من القرارات الإدارية المعيبة بعيب جسيم في المشروعية في أركان القرار الإداري ،حيث أن القرار الإداري يعتبر منعدما إذا صدر من جهة غير مختصة أي عيب عدم الاختصاص الجسيم أو تم التعدي فيه على مبدأ الفصل بين السلطات ، يتخذ القرار الإداري المنعدم صورتين الانعدام القانوني والانعدام المادي ، ويترتب عنه عدم التزام الأفراد بتنفيذه وقيام المسؤولية عنه لوجود ضرر وعدم إمكانية تصحيحه لا بالإجازة أوالتصديق, قيام الإدارة بسحبه متى تفطنت لوجوده, وأجاز القانون لها أن تقوم بسحبه دون تقيد بوقت معين وللقاضي الإداري النظر وفحص القرار الإداري المنعدم . The administrative decision is considered one of the defective administrative decisions with a serious defect in the legitimacy and the pillars of the administrative decision, as the administrative decision is considered non-existent if it was issued by a non-competent party with any serious lack of jurisdiction or infringed upon the principle of separation of powers. Material, and it results in individuals’ non-compliance with its implementation and liability for it due to the existence of damage and the inability to correct it, not by permit or withdrawal, and when it appears to the administration that there is a non-existent decision, the law allows it to withdraw it without specifying a specific time for that.
