    إدراج البعد البيئي في مجـال الصفقـات العمومـية

    لقد شرع المشرع الجزائري عدة قوانين من أجل الحماية القانونية للبيئة بما فيها قانون الصفقات العمومية الذي يرتكز بشكل كبير على الحماية البيئية و إدراج البنود القانونية لحمايتها ، و هذا من أجل الحفاظ على حياة الإنسان في ظل بيئة طبيعية سليمة بعيدة عن المخاطر الطبيعية و الاجتماعية ، و كذا تكريس التنمية الاقتصادية في ظل حماية البيئة و تحقيق التنمية المستدامة التي تعد عجلة الأساسية في دفع بعجلة الاقتصاد نحو التطور و هذا في أطار المحافظة على البيئة و استغلال كل مورد طبيعي فيها بشكله الصحيح ، ومن هنا تبرز علاقة التأثير التأثر بين الحماية القانونية للبيئة والصفقات العمومية كأحد المواد الأساسية لذلك فإنه اتضحت المعلومات التقنية و العلمية و الاقتصادية اللازمة لبيان الأساليب الواجب اتخاذها للمحافظة على هذه الثروة الطبيعية و حماية الغلاف من المخاطر التي قد تتعرض لها هذه الثروة نتيجة للتلوثات المناخية و الصناعية التي تتسبب في إتلافها . The Algerian legislator has enactedseverallaws for the legal protection of the environment, including the Public Procurement Law, whichisbasedlargely on environmental protection and the inclusion of legal provisions for its protection. This is in order to preservehuman life in a healthynaturalenvironmentawayfromnatural and social risks, as well as to devoteeconomicdevelopment in light of protecting the environment and achievingsustainabledevelopment, whichis the main wheel in driving the economytowardsdevelopment, and thisiswithin the framework of preserving the environment. And the proper use of everynaturalresource in itHence, the effectrelationshipbetween the legal protection of the environment and public deals emerges as one of the basic materials. Therefore, the technical, scientific and economic information necessary to indicate the methods to betaken to preservethisnaturalwealth and protect the coverfrom the risksthatthiswealthmaybeexposed to as a result of climatic pollution and industrythat causes damage.
