    تعتبر الغابات أحد مرتكزات البيئة لما لها من أهمية في التأثير على المحيط بشكل عام خاصة ما تعلق بالمناخ ، والرطوبة والأمطار ، إضافة إلى كونها مصدر للثروة النباتية و مجال للرعي والإستعمالات المختلفة الإستهلاكية كالخشب والخدمات الترفيهية والسياحية . تقتضي الغابات وسائل إدارية لحماية خاصة بها لما تتعرض له من مخالفات خاصة ما تعلق بالتلوث والإستغلال العشوائي المنتجات الغابية كالرعي العشوائي وإقامة المنشآت الصناعية . حدد القانون 84 12 النظام العام للغابات وسائل إدارية حمايتها إلى جانب الإطار الجزائي.

    حقوق الطفل الأسرية في الشريعة الإسلامية وتطبيقاتها في قانون الأسرة الجزائري

    الغرض من هذه الدراسة هو تسليط الضوء على حقوق الطفل داخل الأسرة في الشريعة الإسلامية ومن خلال قانون الأسرة الجزائري، وبيان مدى اهتمامهما بالطفل ورعايتهما وحفظهما لحقوقه، وإبراز دور الأسرة والوالدين في حفظ وحماية هذه الحقوق. ويهدف هذا البحث إلى نشر ثقافة حقوق الطفل في الأسرة والمجتمع، والتعريف بها عند أصحاب القرار، والهيئات التشريعية ومن يتولُّون صياغة وإعداد القوانين، ولدى السلطات القضائية المختصة، ومنظمات المجتمع المدني ذات الصلة. ويجيب هذا البحث عن الإشكالية التالية: ما هي حقوق الطفل على أسرته التي كفلتها الشريعة الإسلامية وجسدها قانون الأسرة الجزائري؟ وتعتمد هذه الدراسة على المنهج الوصفي التحليلي المقارن، فتصف الطفل ومراحل نموه، وتحلل وتقسم الموضوع إلى المراحل العمرية التي يمرُّ بها الطفل، ومن ثم دراستها وتفسيرها وتحليل النصوص الشرعية والقانونية، ومقارنة الشريعة الإسلامية بقانون الأسرة الجزائري. ومن خلال هذه الدراسة نُدرك سمو الشريعة الإسلامية وصلاحها لكل زمان ومكان وشمولها لجميع شؤون البشر كلها، وأنها جاءت لحفظ الإنسان ومراعاته في كل مراحل حياته ومنها مرحلة الطفولة، وقد سبقت كل القوانين الوضعية في تقرير حقوق الطفل، كما أن المشرع الجزائري كفل للطفل حقوقه المقررة شرعا، فساير الشريعة الإسلامية في الكثير من الحقوق. The purpose of this study is to shed light on the rights of the child within the family in Islamic law and through the Algerian family law, and to show the extent of their interest in the child and their care and preservation of his rights, and to highlight the role of the family and parents in preserving and protecting these rights, and this research aims to spread the culture of child rights in the family and society And make them known to decision-makers, legislative bodies and those in charge of drafting and preparing laws, and to the competent judicial authorities and relevant civil society organizations. This research answers the following problem: What are the rights of the child to his family that are guaranteed by Islamic law and applied by the Algerian Family Code? This study relies on the comparative analytical descriptive approach, describing the child and his stages of development, analyzing and dividing the subject into the age stages that the child goes through, and then studying and interpreting them and analyzing the legal and legal texts, and comparing Islamic law with Algerian family law. Through this study, we realize the supremacy of Islamic law and its validity for every time And its place and coverage of all human affairs, and that it came to preserve and observe the human being in all stages of his life, including the childhood stage, and it preceded all statutory laws in determining the rights of the child, and the Algerian legislator guaranteed the child his legally prescribed rights, so he followed Islamic law in many rights.
