    The original purposes and the related purposes of the Imam Shatiby The purpose of this study is to uncover the original purposes and related purposes of Imam Shatiby. Not all the purposes of the Islamic Shariaa are of importance to a single order. One of the purposes is what is meant by authenticity and what is intended according to it. Accordingly, Imam Al-Shatiby (may God have mercy on him) Legitimacy of the original purposes and purposes of the subsidiary. In this framework comes the study to show the importance of this division and its dimensions. To determine the course of this study, the following questions were asked: - What is the truth of the original purposes and related purposes of the Imam Shatiby? What is the relationship between them? What is the impact of the original purposes and the related purposes of the jurisprudential consideration and the actions of the assignees? The study attempted to answer this problem through the statement of the truth of the original purposes and their sections at Imam Shatiby and the importance of taking into account the work, and then showed the reality of the related purposes and its importance and sections of Imam Shatiby, with the statement of the rule of each section. This study has shown the relationship between the original purposes and the related purposes, to conclude that the subordinate purposes, if according to Shariaa, are complementary and serve the original purposes. If the objectives are contrary to the original purposes, they are unlawful and the intention is incorrect.     عدول المجتهد عن القول الراجح إلى القول المرجوح في المذهب المالكي- دراسة تأصيليّة تطبيقيّة

    حاولت هذه الد ّ راسة الإجابة على الإشكالية الرئيسية الآتية: إذا كان الأصل هو الأخذ بالقول ّ الراجح والعمل به، فمتى يجوز للمجتهد العدول عن ّ القول الراجح إلى القول المرجوح، وما تجلّيات ذلك في المذهب المالكي؟ وقد بيّ ّ نت هذه الدراسة ّ حقيقة القول الراجح في المذهب المالكي وهو ما قَِو َي دليلُ ّ ه وأن العمل به ٌ واجب في الأحوال العاديّة باتّ ّ فاق الفقهاء، وأما القول المرجوح فإنّ ّ ه يشمل القول الض ّ عيف والقول الشاذ في المذهب المالكي، وأنّه لا يجوز العمل بالقول المرجوح إلاّ ّ عند الاقتضاء في حالات استثنائية خاصة وبضوابط معيّ ّ نة، كما خلصت الدراسة إلى بيان القواعد الأصوليّة التي علاقة ذا العدول، وختمت ّ بتوضيح أهم ّ أسباب عدول ا تهد عن الراجح إلى القول المرجوح وتطبيقا ا في المذهب المالكي.
