    تنظيم مهنة الوكيل العقاري في القانون الجزائري

    الوكيل العقاري هو شخص طبيعي أو معنوي يُفوّض من قبل الموكل للقيام بمهام تتعلق بالعقارات نيابة عنه ، سواء في البيع أو الشراء أو التأجير أو التسيير ، وذلك باسم ولحساب الموكل . يشمل نشاطه كلا من الوكالة العقارية، الوساطة العقارية، وإدارة الأملاك. تتطلب ممارسة هذه المهنة شروطا قانونية محددة، منها ما يتعلق بالشخص( كالأهلية و المؤهلات)، ومنها ما يتعلق بالنشاط نفسه ، كالحصول على الاعتماد المسبق من الوالي والقيد في السجل التجاري. يقتصر نشاط الوكيل العقاري على الأملاك الخاصة ، دون الأملاك العامة إلا إذا نص القانون على خلاف ذلك ، ويترتب عن هذا النشاط حقوق للوكيل مثل الأجرة ، والتزامات تعاقدية يجب احترامها ، وإلا قد يتحمل المسؤولية المدنية أو الجزائية بحسب طبيعة الخطأ المرتكب . A real estate agent is a natural or legal person authorized by a principal to carry out real estate related tasks on their behalf, in their name and for their account. This includes the sale, purchase, rental, and management of private real estate properties. The agent’s activity covers real estate agency services, real estate intermediation, and property management. To legally practice this profession, specific conditions must be met, both personal (such as legal capacity and professional qualifications) and professional such as obtaining prior authoriza-tion from the wàli and registration in the commercial register. The agent’s scope of work is limited to private properties, unless otherwise provided by law the exercise of this profession grants the agent rights –such as remuneration-and imposes contractual obligations. Failure to comply may result in civil or criminal liability, depending on the nature of the breach.
