    الرقابة على التنظيمات في التشريع الجزائري

    تعتبر التنظيمات وسيلة لممارسة السلطة التنظيمية المقررة بموجب المادة 141 من التعديل الدستوري لسنة 2020 والتي تعكس المجال الواسع والغير محدد لها خاصة التنظيمات المستقلة الصادرة عن رئيس الجمهورية، الأمر الذي فرض على المؤسس الدستوري التأسيس للرقابة على التنظيمات من خلال الرقابة الدستورية والرقابة القضائية عن طريق مؤسسات دستورية مستقلة تمارس عملية الرقابة المنوطة بها وفق آليات وضوابط وإجراءات محددة، تجسيدا لمبدأ المشروعية وبالتالي سيادة القانون. Regulations are considered a means of exercising the regulatory authority established under Article 141 of the 2020 constitutional amendment, which reflects their broad and undefined scope, especially the independent organizations issued by the President of the Republic. This necessitated the constitutional founder to establish oversight over these organizations through constitutional and judicial oversight mechanisms, implemented by independent constitutional institutions that exercise the required oversight through specific mechanisms, controls, and procedures, embodying the principle of legitimacy and thus the rule of law.
