    في إطار إحاطة أموال القاصر المعاق، بالقدر الكافي ،من الحماية إلى بلوغه سن الرشد ،أخضعه المشرع لنظام الولاية من خلال قانون الأسرة كأحد أهم النظم النيابية ،متأثرا بذلك بما جاءت به مبادئ الشريعة الإسلامية ،حيث مكن الولي –أبا كان اوأما كفيلا – من مباشرة بعض السلطات التي تتيح له إدارة أموال القاصر المعاق والتصرف فيها In order to protect the minor handicapped's assets till he reaches the age of majority, the legislator subjected him to the guardianship system through the family law as one of the court systems influenced by the Islamic Shariah. One of the principles of this Shariah gave the partner ( guarantor" father or mother") the right to manage minor handicapped's assets.
