    تهدف هذه الدراسة إلى التطرق لضوابط السلطة التقديرية للقاضي الجنائي ما بين الشريعة الإسلامية والقانون الوضعي، وذلك من خلال المقارنة بينهما من حيث أوجه التشابه وأوجه الاختلاف، فنجد أن كليهما يتفقان على تحديد حدود وضوابط السلطة التقديرية للقاضي مما يجعلها تنتقل من سلطة حرة مطلقة إلى سلطة مقيدة تقيد مهمته في تقدير العقوبات المناسبة، بينما يختلفان في أن الضوابط في القانون الوضعي تتمثل في عقوبة ذات حد أعلى وحد أدنى،في حين أنها في الشرع عبارة عن عقوبات ذات حد واحد أو حدين اثنين This study aims to address the controls of the discretionary power of the criminal judge between Shariah and criminal law, by comparing them in terms of similarities and differences. They agree to define the limits and criterions of the discretionary power of the judge, which makes it move from an absolute free power to a restricted power that restricts his task in estimating appropriate penalties, while they differ in that the criterions in criminal law are represented in a penalty with a maximum limit and a minimum limit, while in Sharia they are penalties with one or two limits.
