    في ظل التحولات العميقة التي يشهدها العالم نتيجة التطور المتسارع في تقنيات الذكاء الاصطناعي، لم يعد يُنظر إلى هذه التكنولوجيا بوصفها أداة تقنية فحسب، بل أصبحت تمثل قوة فكرية واجتماعية تُعيد تشكيل المفاهيم التقليدية التي لطالما كانت مستقرة في الوعي البشري. فالأنظمة الذكية تجاوزت حدود الدعم التقني إلى مستوى اتخاذ قرارات مستقلة، ما يفرض تحديات على العلاقة بين الإنسان والآلة، ويستدعي مراجعة جوهرية لمفاهيم المسؤولية، والمساءلة، بغرض التصدي عن الأضرار التي تسببها. وبالتالي فإن التحدي الحقيقي لا يكمن فقط في ضبط التكنولوجيا، بل في صياغة إطار قانوني وأخلاقي يُمكّن من إدماج الذكاء الاصطناعي بشكل متوازن ومسؤول داخل المجتمع، وهذا يتطلب إعادة بناء قواعد المسؤولية المدنية وتبني فلسفة قانونية جديدة تُراعي خصوصيات هذه التقنية، وتوازن بين تشجيع الابتكار من جهة، وضمان حماية الحقوق الفردية والجماعية من جهة أخرى. In the age of profound transformations, the world is witnessing due to the rapid advancement of artificial intelligence technologies, AI is no longer viewed merely as a technical tool. Instead, it has become an intellectual and social force reshaping traditional concepts that have long been rooted in human consciousness. Intelligent systems have gone beyond providing technical support to making independent decisions, which presents challenges to the human-machine relationship and calls for a fundamental reevaluation of the concepts of responsibility and accountability, in order to address the damages it causes. Thus, the real challenge lies not only in regulating technology but in formulating a legal and ethical framework that enables the integration of AI into society in a balanced and responsible manner. This requiresthe foundations of civil liabilityand adopting a new legal philosophy that takes into account the unique characteristics of this technology, while balancing the encouragement of innovation with the protection of individual and collective rights.
