    تشكل ظاهرة التلوث البيئي صعودا سريعا، كقضية فرضت نفسها و أخذت مكانا متقدما على جداول الدول و الحكومات العالم، باعتبار هذه الظاهرة تشكل أكبر التحديات الراهنة للبيئة في مناهجها الاقتصادية و الاجتماعية ، و ظهور صناعات معقدة التي نتجت عنها ، آثار جد سلبية مؤثرة بشكل خطير على البيئة و هذا بالإضافة إلى أن الضرر البيئي فيها يتحقق بشكل تدريجي لا بدفعة واحدة ، كل هذه العوامل و أخرى تجعل من دراستنا تنصب على الأساس القانوني الذي يمكن للمتضرر الإسناد إليه للحصول على التعويض المناسب جزاء ما لحق به من أضرار البيئة. The phenomenon of environmental pollution is rapidly rising, as an issue that has imposed itself and has taken a place ahead of the tables of countries and governments of the world, as this phenomenon poses the biggest current challenges to the environment in its economic and social curricula, and the emergence of complex industries that have resulted, very negative effects seriously affecting the environment and this in addition to the fact that environmental damage is achieved gradually not in one batch, All these and other factors make our study focus on the legal basis on which the victim can be assigned to obtain appropriate compensation for the damage done to the environment.
