    التحكيم ينشأ عن مصدر اتفاقي يعرف باتفاق التحكيم جوهر العملية التحكيمية, يؤدي إلى تمكين الأطراف من اختيار طريق التحكيم كأسلوب لحل نزاعاتهم التجارية،كذلك تتجسد أبعاد هامة لاتفاق التحكيم من خلال منح المحكم سلطة الفصل في النزاع بقرار ملزم كما يسيطر على مسيرة العملية التحكيمية كلية ابتداء من تعيين المحكم وتحديد مهامه مرورا باختيار القواعد القانونية الواجبة التطبيق على النزاع وانتهاء بإجراءات القاضي أمام هيئة التحكيم. Arbitration arises from an agreed-upon source known as the arbitration agreement, the essence of the arbitration process. It enables the parties to choose arbitration as a method for resolving their commercial disputes. Furthermore, the arbitration agreement embodies important dimensions by granting the arbitrator the authority to resolve the dispute with a binding decision. It also controls the entire course of the arbitration process, from the appointment of the arbitrator and the definition of his or her duties, through the selection of the legal rules applicable to the dispute, to the judge's procedures before the arbitration panel.
