    آليات إلزام الإدارة لتنفيذ الأحكام القضائية

    تتناول هذه الدراسة إشكالية امتناع الإدارة عن تنفيذ الأحكام القضائية، باعتبارها مساسًا بمبدأ المشروعية ومكانة القضاء. وقد اعتمدنا المنهج الوصفي التحليلي لدراسة الإطار الدستوري والقانوني المنظم للتنفيذ، وتحليل دور القضاء الإداري في فرض احترام الأحكام، خصوصًا من خلال الأوامر التنفيذية والغرامات التهديدية، وكذا دراسة المسؤولية الجزائية للموظفين الممتنعين. وتوصلت الدراسة إلى أن ضعف التفعيل العملي للآليات القانونية يُعد العائق الأكبر أمام ضمان التنفيذ. وأوصت بضرورة تعزيز الرقابة المؤسساتية، وتفعيل المتابعة القضائية، لنشر ثقافة احترام الأحكام القضائية وترسيخ دولة القانون. This study addresses the issue of the administration’s refusal to enforce judicial decisions, considering it a violation of the rule of law and the authority of the judiciary. The descriptive-analytical method was adopted to study the constitutional and legal framework regulating enforcement, and to analyze the role of administrative courts in ensuring compliance, particularly through enforcement orders and coercive fines, as well as examining the criminal responsibility of officials who refuse enforcement. The study concluded that the limited practical activation of legal mechanisms remains the main obstacle. It recommends strengthening institutional oversight and judicial follow-up to promote a culture of respect for judicial rulings and consolidate the rule of law.
