    العرف ودوره في حل النزاعات في البوادي المغاربية خلال القرنين 18 و19 م موريتانيا والصحراء الجزائرية نموذجا

    لقد هدفت هذه الدراسة إلى الدور الذي لعبه العرف والقانون العرفي في قبائل موريتانيا وقبائل وقصور الصحراء الجزائرية خلال القرنين الثامن عشر والتاسع عشر ميلاديين ، حيث اعتمدت البوادي المغاربية على العرف ومؤسساته العرفية في حل النزاعات بين القبائل والأشخاص وتسوية حياتهم باعتبار أن العرف من صنع الجماعات ،حيث أن العرف في هذه القبائل أغلبه لا يخالف الشريعة This study aimed to examine the role played by custom and customary law among the tribes in Mauritania and the Algerian desert during the eighteenth and nineteenth centuries. It focused on the reliance of tribal communities on custom and its traditional institutions in resolving disputes between tribes and individuals, and in settling their cases by considering custom as a source of societal legislation. The study found that custom in these tribes mostly does not contradict Islamic Sharia.
