تعتبر القواعد القانونية الدعامة الأساسية في الحفاظ على العلاقات الموجودة بين الأفراد وذلك قصد تحقيق هدفها السامي لاستقرار وأمان المعاملات بينهم ،اذ تعمل القواعد القانونية على حماية هذه الحقوق،ومن بينها حق الارتفاق الذي يعد أهم الحقوق العينية على الاطلاق. الذي هو موضوع دراستي وله امتداد تاريخي عبر أزمنة كثيرة وعديدة، فقد كان مقررا قبل العصور الإسلامية وفي صدر الإسلام ،كما أن المشرع الجزائري بدوره خصص أحكامًا في النصوص القانونية فلزم استحداثّ نظام يمنع تصادم الناس في استغلال كل منهم لأملاكه خاصة العقارية الفلاحية. Legal rules are considered the mainstay in preserving existing relationships between individuals in order to achieve its lofty goal of stability and security of transactions between them, as legal rules protect these rights, including the easement right, which is the most important right in kind at all. Which is the subject of my study and has a historical extension through many and many times, as it was decided before the Islamic eras and in the early days of Islam, just as the Algerian legislator, in turn, specified provisions in the legal texts, so it was necessary to create a system that prevents people from colliding in the exploitation of each of them for his property, especially agricultural real estate.
