    الجزاءات الإجرائية في قانون الإجراءات الجزائية الجزائري

    تبنى المشرع الجزائري فكرة الجزاءات الإجرائية وضمنها في قانون الإجراءات الجزائية الجزائري بهدف إرساء القواعد القانونية وتطبيقها بالشكل الصحيح من جهة ومن جهة أخرى تفعيل التطبيق الجاد للشرعية الاجرائية, ويهدف هذا الجزاء لضمان حسن سير العدالة الجنائية وحسن سير القضاء, والأهم من ذلك أيضا إحترام حقوق الأفراد وحرياتهم, وكل أنواع الجزاء الاجرائي تحكمه نظرية عامة في قانونالاجراءات الجزائية ألا وهي نظرية البطلان. The Algerian legislator adopted the idea of procedural penalties and included them in the Algerian Code of Criminal Procedure, with the aim of establishing legal rules and applying them in the correct manner on the one hand, and on the other hand activating the serious application of procedural legality. Individuals and their freedoms, and all types of procedural penalty are governed by a general theory in the Code of Criminal Procedure, which is the theory of nullity. Le législateur algérien a adopté l'idée des peines procédurales et les a inscrites dans le code de procédure pénale algérien, dans le but d'établir des règles de droit et de les appliquer de manière correcte d'une part, et d'autre part d'activer l'application sérieuse Les personnes et leurs libertés ainsi que tous les types de peine procédurale sont régis par une théorie générale du Code de procédure pénale, qui est la théorie de la nullité.
