    من خلال دراستنا لموضوع سلطة القاضي اتجاه حق الزوجة في فك الرابطة الزوجية الذي عالجنا فيه كل كبيرة و صغيرة فيما يخص انحلال الرابطة الزوجية بطلب من الزوجة محاولين الإحاطة بكل جوانب هذا النوع من الطلاق الذي هو متمثل في صورتان ) التطليق و الخلع ( ، فإن التطليق لا يكون إلا بطلب من الزوجة ويخضع للسلطة التقديرية للقاضي إذا توافرت فيه الشروط ، أما الخلع بكون بطلب من الزوجة بتقديم مال للزوج تفتدي به نفسها ويكون بدون أي سبب مقنع ولا يشترط فيه ذلك .
