Studysummary: This studyaims to find out the legalmechanism by whichendowmentproperty can berecovered by searching the legal system for legaltermsdefined by the lawthatindicate and indicate the meaning of restitution of endowmentproperty. andthentry to applythosemechanisms in a model study of the King of Waqfi, Our choiceis on the King of Real Estate to stop Sidi Ebrar, a group of shops belonging to threemosques of Badr mosque, Al-Atiq and Ali Ibn Abi Talibdirectingbenefits to the maintenance of Sidi Ebazcemetery. The studywasalsoconducted in order to learn about the contribution of Islamic jurisprudence and Algerian law to the restoration of the moratorium by searching for alternative termsused by the Algerian codifier to express the process of restitution of property, searching the cases in which the guardianintervenes to recover the property, as well as disclosing the actions taken by Algerian law to recover the property. The studydrew on the comparative analytical descriptive approach to address the legalsystem'shypothesis of havingmechanismsthatcouldrecoverlost, looted or exploitedendowmentproperty. The studyfoundthat the process of restitution of endowmentsneeded to legislate new laws, ministerialdecrees and leafletscommon to several administrative interests to cooperate and facilitate the process of restitution of real estatewithintheirlegal and regulatoryframework.
