    مبدأ المعاملة بالمثل -دراسة مقارنة بين الفقه الإسلامي والقانون الدولي-

    إن المعاملة بالمثل مبدأ معمول به في الدارين الدنيا والآخرة، في الفقه الإسلامي والقانون الدولي، وهذا لأن الله يجازي كل إنسان على عمله صالحاً كان أم غير ذلك، فأما عن العمل الحسن فالله فَمَنَ على الإنسان من أن يجازيه بقدرعمله، بل أكثر ودليل هذا قوله تعالىﭐﱡﭐ ﱾ ﱿ ﲀ ﲁ ﲂ ﲃﲄ ﲅ ﲆ ﲇ ﲈ ﲉ ﲊ ﲋ ﲌ ﲍ ﲎ ﲏ ﱠ(سورة الأنعام، الآية: 160). أما في المعاملات العادية بين الناس فهناك من يعامل بالمثل وآخر من يعامل بالفضيلة والأخلاق الحسنة ومبدأ المعاملة لا يتنافى مع مبدأ العدالة في القانون أوالتسامح بل هو مبدأشرعي معمول به في العلاقات الدولية، في أغلب دول العالم كالمغرب والجزائر عند فرض التأشيرة وكذا في المملكة العربية السعودية Reciprocity is a principle applied in the world and the hereafter، in Islamic jurisprudence and international law، and this is because God rewards every human being for his good deeds or otherwise. (He who brings a good deed will have ten times like it، and he who brings a bad deed will only be recompensed with the like of it، and they will not be wronged) Surah Al-An’am، verse 160. As for normal dealings between people، there are those who are treated reciprocally and others who are treated with virtue and good morals. The principle of treatment does not contradict the principle of justice in law or tolerance. Rather، it is a legitimate principle in force in international relations، in most countries of the world، such as Morocco and Algeria when imposing a visa، as well as in the Kingdom of Saudi Arabia
