    قيود حرية النيابة العامة في تحريك الدعوى الجزائية في التشريع الجزائري

    تناولت الدراسة القيود الواردة على حرية النيابة العامة في تحريك الدعوى الجزائية في القانون الجزائري ووضعت هاته القيود على النيابة العامة للحد من حريتها في تحريك الدعوى الجزائية، وهي تلك المتعلقة الشكوى والطلب والاذن. فالمشرع الجزائري يرى بأن للمجني عليه الحق أن يقدم شكواه أو طلبه أو أخذه الإذن لمعاقبة الجاني أو التنازل عن حقه في المتابعة الجزائية، وخصصت لكل قيد من قيود الدعوى الجزائية نوع من جرائم معينة دون غيرها.. The study dealt with the restrictions on the freedom of the Public Prosecution to file a criminal case in Algerian law, and placed these restrictions on the Public Prosecution to limit its freedom to file a criminal case, which are those related to the complaint, the request and the permission. The Algerian legislator believes that the victim has the right to submit his complaint or request or take permission to punish the offender or waive his right to criminal prosecution, for each criminal case, a type of specific crime was allocated to the exclusion of others.
