    أوامر قاضي التحقيق في قانون الإجراءات الجزائية الجزائري

    إن الأوامر التي يصدرها قاضي التحقيق تختلف بحسب وقت إصدارها و طبيعتها و أهميتها و القواعد المطبقة عليها و كذلك الأثار القانونية الناتجة عنها، إلا أنه يمكن القول بأن هذه الأوامر تمر بثلاث مراحل ، وأولها الأوامر التي تصدر عند فتح التحقيق، و المتعلقة بأوامر الاختصاص و التحقيق و الادعاء المدني، ثم تأتي بعدها الأوامر الصادرة أثناء سير التحقيق مثل الأوامر القصرية و الأمر بالحبس المؤقت و الرقابة القضائية، أما أخيرا فأنه يصدر الأوامر المنهية للتحقيق مثل الأمر بألا وجه للمتابعة أو أوامر الإحالة، وكل هذه الأوامر ليست تصدر بشكل نهائي قطعي بالدرجة الأولى و إنما يمكن الطعن فيها بالاستئناف The ordres issued by the investigating judge vary depending on their timing and natureand their importance, the applicable rules, and also the legal consequences resulting from them, However, it can be said that these orders go through three stages, The first stage includes orders issued at the opening of the investigation, relating to jurisdiction, investigation, and civil prosecution orders. Finally, the investigating judge issues orders terminating the investigation, such as orders of dismissal or referral orders, and All of these orders are not issued as final and conclusive in the first degree, and they can be challenged through an appeal.
