    دور القضاء العقاري في ارساء السجل العقاري في الجزائر

    تتناول هذه الاطروحة مساهمة الاحكام القضائية الصادرة في المادة العقارية سواء من طرف القضاء العادي او القضاء الإداري، في تكريس مبادئ السجل العقاري، واحترام الإجراءات القانونية المتعلقة بوجوب شهر الدعاوى القضائية والاحكام القضائية الصادرة بشان المنازعات المثارة، باعتبار ان السجل العقاري جاء لتطهير العقار ولتحقيق الاستقرار في المعاملات العقارية، وبالمقابل أيضا فان للقضاء دور مطهر للعقار وعامل رئيسي في تجسيد الامن القانوني العقاري، اذا تطابقت اركان الحكم القضائي مع قواعد السجل العقاري وتم احترام شكليات الاشهار، بما يسهم في التنمية الاقتصادية بالنظر لما للعقار من وزن اجتماعي، اقتصادي وتنموي. This thesis deals with the contribution of judicial rulings issued in real estate matters, whether by the ordinary judiciary or the administrative judiciary, in consecrating the principles of the real estate registry and respecting the legal procedures related to the necessity of notifying lawsuits and judicial rulings issued regarding the disputes raised, considering that the real estate registry came to purify the property and achieve stability in Real estate transactions. On the other hand, the judiciary also has a role in purifying real estate and is a major factor in embodying real estate legal security, if the elements of the judicial ruling are consistent with the rules of the real estate registry and the formalities of publicity are respected, which contributes to economic development given the social, economic and developmental weight of real estate.
