حرية الرأي للموظف العمومي في التشريع الجزائري

Abstract

ينصب موضوع هذه الدراسة حول حرية الرأي للموظف العام في التشريع الجزائري ، وذالك لموازنة هذه الحرية بين ممارستها و بين القيود المفروضة عليها ، ومدى موائمة التشريع الجزائري مع المواثيق الدولية التي لها علاقة بحرية الموظف العام في التعبير عن رأيه ، وذالك من خلال بيان مفهوم حرية الموظف العام في التعبير عن رأيه ، وبيان صور وضمانات هذه الحرية من جهة و بيان القيود المفروضة على التي تنصب على عاتق الموظف العمومي فتكون تلك القيود متعلقة بالموظفين وحدهم كواجب الطاعة الرئاسية وواجب التحفظ الذي يشمل الولاء بكافة صوره ، الامر الذي استدعى وجود ضمانات دستورية ووظيفية تكفل ممارسة الموظف العام لهذه الحرية The subject of this study is about the freedom of opinion of the public employee in the Algerian legislation, in order to find the perfect balance of freedom practice and the restrictions imposed on it, and to what extent the Algerian legislation is compatible with international covenants that have a relationship with the freedom of the public employee to express his opinion, and that is through explaining the concept of freedom of the general employee in expressing his opinion, and to clarify the forms and guarantees of this freedom on one hand, and to clarify the restrictions imposed on the public employee, so that these restrictions are related to employees alone, such as the duty of presidential obedience and the duty of job secret safe keeping including loyalty in all its forms، which necessitated the existence of constitutional and functional guarantees to ensure the public employee's exercise of this freedom.
