خصوصية الجريمة الصحفية في النظام القانوني الجزائري

Abstract

تهدف هذه الدراسة إلى تبيان مدى الخصوصية والتميز الذي تتمتع بها الجرائم الصحفية، كونها تقوم على ركن خاص ألا وهو ركن العلانية ،وتنقسم هذه الجرائم إلى قسمين منها ما هو ماس بالشأن العام ومنها ماهو ماس بالشأن الخاص، ولقد جاء المشرع الجزائري بهذا الخصوص بجملة من القوانين التي تجرم هاته الأفعال وذلك من خلال قانون العقوبات الجزائري والقانون العضوي المتعلق بالإعلام، نظرا للأثر الذي تخلفه خاصة في ظل التطور السريع لوسائل الإعلام والنشر والاتصال الجماهيري المؤثرة على الرأي العام ويمكن القول عنها أنها سلاح ذو حدين سلبي و إيجابي، مما استوجب على المشرع اتخاذ مجموعة من الإجراءات المنظمة لهذه المهنة من خلال القوانين السالف ذكرها.
