Abstract

إن موضوع تقسيم المال على نسب الميراث قبل الوفاة من أهم المواضيع التي يجب البحث فيها والتعرف على رأي الفقه الاسلامي وكذلك القانون الجزائري في هذا التصرف. الله عز وجل تولى تقسيم الميراث ولم يفوض ذلك الى أحد من خلقه، فجاءت آيات المواريث شاملة لكل ما يمكن وقوعه. فتوزيع الرجل تركته وأمواله قبل موته غير جائز، ذلك لأن موت المورث شرط أساسي من الشروط التي فرضها الاسلام للإرث، وشروط الارث أولها تحقق موت المورث، وقد يولد لهذا الشخص بعد التوزيع ولد اخر، في هذه الحالة يكون قد ظلم هذا الولد في الوقت الذي يؤمر فيه بالتسوية بين أولاده. لكن يمكن له توزيع أمواله على أولاده حال حياته، ولكن يعتبر هبة ولا يعتبر ميراث، وعليه يجب المسواة والعدل بين جميع أولاده، وأن يكون في حال صحته وليس في مرض موته.
