الأسس القانونية لاكتساب الجنسية وفقدها واستردادها

Abstract

الجنسية رابطة قانونية تصل الفرد بالدولة أي أن الجنسية هي الإطار القانوني الذي ينظم علاقة الفرد بالدولة منجميع جوانبها مما يضفي على الفرد في الدولة صفة قانونية تسمح له بممارسة الحقوق التي تخولها الدولة لأفرادها ويتحمل بالتزامات التي تفرضه عليه ويدخل بيها ضمن الجماعة الوطنية، بالتالي يمكن التمييز بين مواطني الدولة وبين الأجانب فيها وفقا للجنسية التي يحملونها، غير أن هذا الأجنبي يمكن اكتساب جنسية أخرى غير الأصلية التي يحملها وفقا لشروط واجراءات معمول بها، كما يمكن التخلي عن الجنسية من طرف الأصلي والدخيل إما بإرادة الفرد كما قد يفقدها دون إرادته.

Nationality is a legal association that connects the individual to the State and nationality is the legal framework governing the individual's relationship with the State in all its aspects, which gives the individual in the State legal status that allows him to exercise the rights granted by the State to its members and to assume obligations imposed on him and to enter into it within the national community, so that citizens of the State can be distinguished from the state and foreigners there in accordance with the nationality they hold, but this foreigner can acquire a nationality other than the original one he holds in accordance with applicable conditions and procedures, and can be abandoned nationality by the original and the outsider either by the will of the individual as he may lose it without his will.
