Abstract

تتناول هذه الدراسة أثر الوفاة على العقود المالية من وجهتي نظر الفقه الإسلامي والقانون الجزائري، مع التركيز على كيفية انتهاء العقود أو استمرارها بعد وفاة أحد الأطراف. تبدأ الدراسة بتعريف الوفاة والعقود المالية، ثم تستعرض القواعد الفقهية والقانونية المتعلقة بانتهاء العقود عند الوفاة، وتصنيف العقود إلى تلك التي تنفسخ بالوفاة وتلك التي تستمر. كما تناقش التطبيقات العملية في المجال المصرفي، خصوصًا فيما يتعلق بالحسابات البنكية والعقود التمويلية والتأمينية بعد الوفاة. تهدف الدراسة إلى تقديم تحليل مقارن شامل يوازن بين المبادئ الشرعية والتشريعات المدنية الحديثة، مع اقتراح توصيات تسهم في تطوير الإطار القانوني والفقهي بما يتناسب مع متطلبات العصر. This study explores the impact of death on financial contracts from the perspectives of Islamic jurisprudence and Algerian law, focusing on how contracts terminate or continue after the death of a party. It begins by defining death and financial contracts, then reviews the jurisprudential and legal rules governing contract termination, categorizing contracts into those that dissolve upon death and those that persist. The study also addresses practical applications in banking, particularly regarding bank accounts, financing, and insurance contracts after death. It aims to provide a comprehensive comparative analysis balancing Islamic principles and modern civil legislation, offering recommendations to enhance the legal and jurisprudential framework in line with contemporary needs.
