ضمانات المشتبه فيه في مرحلة الإستدلال

Abstract

إن الدستور وفر حماية قانونية للمشتبه فيه سواء من الضبطية القضائية أو جهات أخرى ، كما وفر أيضا لعناصر الضبطية القضائية حماية قانونية خاصة أثناء تأدية مهامهم أو بمناسبتها المنصوص عليها في قانون العقوبات ، لذلك رتب مسؤوليات تقع على عاتقهم في أي تهاون أو تقصير يرتكبونه مما يؤدي بهم للمتابعة الجزائية و التأديبية حسب الخطأ المرتكب من طرفهم لقيام المسؤولية مع إمكانية بطلان الإجراء.

The contitution provided legal protection for the suspect. whether from the judicial police or other parties. it also provided judicial officers with the same protection while performing their duties or on the occasion of them provided for in the penal code. Therefore arrange responsibilities that fall on their shoulders in any negligence or failure they commit. which leads them to penal or disciplinary follow-up according to the mistake committed by them to establish responsibility with the possibility of invalidating the procedure.
