جريمة الزنا في القانون الوضعي والشريعة الإسلامية

Abstract

بالنظر الى أهمية هذا الموضوع وحساسيته لما له من تأثير مباشر على استقرار الأسرة وسلامة المجتمع فقد تناول هذا البحث بعنوان" جريمة الزنا في القانون الوضعي والشريعة الاسلامية"، حيث تقسيم هذا الدراسة الى فصلين رئيسيين، خصص الفصل الأول لدراسة الأحكام الموضوعية، جاء فالمطلب الأول مفهوم الزنا وتعريفاته في كل من الفقه والقانون، أما المطلب الثاني فركزنا على بيان أركان جريمة في كلا من النظامين، أما الفصل الثاني عالج الجوانب الإجرائية المرتبطة بالجريمة، حيث تم التطرق الى أدلة الاثبات وطرق تحريك الدعوى العمومية، وكما تم عرض العقوبات المقررة في كلا النظامين، موضحا الفروقات بينهما.

Given the importance and sensitivity of this topic to its direct impact on family stability and societal safety, this research entitled 'The Crime ofAdultery in Secular law and Islamic Sharia ' has been divided into two main chapters: The first chapter is devoted to the study of substantive provisions. The first section addresses the concept of adultery and its definitions in both Islamic jurisprudence and law while identifying the elements of the crime of adultery in both legal systems.The second chapter deals with the procedural aspects related to the crime. It discusses the evidentiary means and the methods of initiatingPublic prosecution it also presents the penalties prescribed in both systems highlighting the differences between them.
