أثر الموت على هبة ختم القرآن في توات

Abstract

يعرض هذا البحث نازلة في باب الهبة، أثارت نقاشا بين علماء توات بصحراء الجزائر، في القرن الثاني والثالث عشر من الهجرة النبوية وهي: الهبة لخاتم القرآن، واختلاف الفقهاء في افتقارها للحيازة. حيث تم العرض بتصوير النازلة وتحرير محل النزاع فيها، ثم عرض الأقوال مع أدلتها، وفي الأخير المناقشة والترجيح، ثم الخلوص إلى أهم النتائج في الخاتمةThe paper deals with a nazila (a Legal issue) in the section of donations that sparked debates amongst scholars and jurisprudents in Twat in the Algerian Sahara during the twelfth and thirteenth centuries of Hegira. That is, the donation to the completer of the Qur’an, and the divergences of jurisprudents regarding the absence of possession. This nazila was presented by depicting the issue and editing the point of divergence in it. Then, presenting the points of view with their arguments, and discussing them to balance these views to highlight the most important results in the conclusion
