Abstract

The issue of alimony is of great importance in Islamic law, because it is directly related to the family in general and the child in particular, as it always seeks to ensure and guarantee his rights in a way that guarantees him a decent and stable life. Our aim in this study is to summarize the issue of estimating the alimony of the child in custody in Islam by analyzing the legal texts from Quranic verses and prophetic hadiths in addition to the sayings of various ancient and contemporary jurists, in addition to the provisions contained in the matter of alimony in both Algerian law and various international conventions related to alimony The cuddled child so that we reached at the end of the research that it is customarily estimated according to the capabilities of the custodian according to the needs of the cuddled, taking into account the circumstances and ability of each of them and ensuring justice for both of them.
