مسؤولية الدولة عن الأخطاء الإدارية

Abstract

تتناول هذه الدراسة موضوع مسؤولية الدولة عن الأخطاء الإدارية، باعتبارها إحدى أهم صور المسؤولية القانونية التي تترتب عن تصرفات الإدارة العامة المخالفة للقانون، مما يؤدي إلى إلحاق الضرر بالأفراد. وقد ركزت الدراسة على الإطار النظري للمسؤولية الإدارية من خلال تعريفها وبيان خصائصها وشروط قيامها، مع تحليل معمق لأنواع الخطأ الإداري وأثر كل منها على تحديد طبيعة المسؤولية. كما تم التطرق إلى التطبيقات العملية للمسؤولية الإدارية أمام القضاء الإداري الجزائري، لا سيما في مجالي المرافق الطبية ومرفق الشرطة، وتحليل الآثار القانونية المترتبة على حق المتضرر في رفع دعوى التعويض. وخلصت الدراسة إلى أن القضاء الإداري في الجزائر قد خطا خطوات مهمة في حماية الحقوق الفردية عبر مساءلة الإدارة وتعويض المتضررين، رغم الحاجة إلى تطوير بعض النصوص الإجرائية لتعزيز فعالية هذا النظام.

This study addresses the issue of State Liability for Administrative Errors, as one of the most important forms of legal liability arising from unlawful actions committed by public administration that cause harm to individuals. The research focuses on the theoretical framework of administrative liability by defining it, outlining its characteristics, and identifying its conditions of establishment. It also provides an in-depth analysis of the types of administrative errors and their impact on the nature of the state's liability. Furthermore, the study explores practical applications of administrative liability before Algerian administrative courts, particularly concerning medical public services and police services, while analyzing the legal effects on the right of victims to claim compensation. The study concluded that the Algerian administrative judiciary has made significant progress in protecting individual rights by holding the administration accountable, although there remains a need to improve procedural laws to enhance the effectiveness of this system.
