Abstract

نتيجة لما شهدته الجزائر من خلال السنوات الأخيرة من تسريب ونشر لبعض المعلومات والوثائق الإدارية الحساسة والمهمة التي مست بأمن الدولة وكيانها، قامت السلطات الجزائرية بإصدار الأمر 21-09 المتعلق بحماية المعلومات والوثائق الإدارية الذي تضمن العديد من آليات الحماية القانونية للمعلومات والوثائق الإدارية والمتمثلة في الآليات الإدارية والآليات العقابية، ومن أهم ما تميز به هذا القانون عن القوانين السابقة التي جرمت نشر وتسريب المعلومات والوثائق الإدارية هو تشديد العقوبة على مرتكبيها وتنظيم إجراءات حماية المعلومات والوثائق الإدارية. الكلمات المفتاحية: تسريب، إفشاء، معلومات، موظف عمومي، وثيقة، نشر، حماية قانونية

Summary: As a result of what Algeria has witnessed in recent years of leaking and publishing some sensitive and important administrative information and documents that affected the security of the state and its entity, the Algerian authorities issued Ordinance 21-09 related to the protection of administrative information and documents, which included several legal protection mechanisms for administrative information and documents represented in administrative mechanisms And punitive mechanisms, and one of the most important features of this law from previous laws that criminalized the publication and leakage of information and administrative documents is the harsh punishment for perpetrators and the organization of procedures for protecting information and administrative documents.
