Abstract

الوساطة القضائية وسيلة لحل بعض النزاعات العقارية التي تنشأ بين الخصوم والتي تعرض على القسم العقاري بطريقة ودية ، دون اللجوء إلى إجراءات القضاء وتشعبها ، ولقد نص المشرع الجزائري بموجب قانون 08-09 أ المتعلق بقانون الإجراءات المدنية والإدارية ، سعيا منه لجعلها أكثر فعالية ، وترتكز الوساطة على إستخدام وسيط سواء كان شخص أو مؤسسة بحيث يلتجأ هذا الوسيط إلى أسلوب الحوار وتبادل وجهات النظر بين المتخاصمين من أجل إيجاد حل مناسب يرضي الطرفين على حد السواء
