التصرف في أموال الزوجة بين الفقه الإسلامي والقانون الجزائري

Abstract

التصرف في أموال الزوجة دراسة مقارنة بحث تناولت فيه ما يثبت في ذمة الزوجة من أموال شرعية، مثل الصداق والهبة والوقف والميراث واستحقاق الزوج في التصرف بتلك الأموال. تعرضت فيه لمفهوم الحق وأقسامه ، وماهية الحقوق المشتركة بين الزوجين ، وحقوق الزوج على زوجته ، وحقوق الزوجة على زوجها المادية والمعنوية، كما تطرقت إلى مفهوم الذمة المالية وعلاقتها بالأهلية ومدى استقلال ذمة الزوجة المالية عن زوجها وحقها في التملك والتصرف في مالها، مع توضيح موارد مال الزوجة ومورداها المادية قبل الزواج وبعد الزواج ، وحكم مساهمتها بالأنفاق على الأسرة خاصة في حالة إفلاس الزوج .This research examines the management of a wife's legitimate financial assets, such as dowry, gifts, endowments, inheritance, and the husband's entitlement to handle these funds. It explores the concept of rights and their categories, the nature of shared rights between spouses, the husband's rights over his wife, and the wife's material and moral rights over her husband. Additionally, it delves into the concept of financial responsibility and its relationship to marital status, exploring the extent of a wife's financial independence from her husband and her right to ownership and management of her own finances. The research also clarifies the sources of the wife's financial resources and assets both before and after marriage, as well as the implications of her contribution to family expenses, particularly in cases of the husband's insolvency.
