Abstract

لم تعد الرياضة مجرد هواية فمع بداية الاحتراف في الجزائر وتحول النادي الرياضي الى شركة تجارية وتحول الرياضي الى عامل، و أصبح هناك العديد من العقود الرياضية، مثل عقد اللاعب المحترف وعقد المدرب الرياضي، ومعلوم أن المشكلات التي يطرحها العقد الرياضي كثيرة ومتنوعة وخصوصا في مرحلة ما قبل إبرام العقد، وللعقد الرياضي مجموعة من الخصائص التي تميزه عن باقي العقود الأخرى كما توجد صعوبات في تكييفه إن الأصل بالنسبة للرياضي باعتباره عاملا لدى النادي الرياضي الذي يعتبر مستخدم أو صاحب عمل، انه يخضع لذات الالتزامات التي يخضع لها باقي العمال، بالإضافة الى التزامات أخرى تفرضها الصبغة الرياضية على العمل، حيث أنه فضلا عن التزامه بأداء العمل الرياضي وبذل العناية اللازمة في ذلك وكل ما يتطلبه العمل، فإنه يلتزم بالتزامات أخرى تتعلق أساسا بنشاطه الرياضي.
