Abstract

القصد الجنائي يُعتبر العنصر الأساسي في الجانب الأخلاقي للجريمة، حيث لا يُمكن للمُتهم أن يُحاسب على نشاط جنائي ما لم يتم تأكيد مسؤوليته الجنائية، فبدون القصد الجنائي، يُعتبر الفعل المُشتبه به مجرد تصرُف عابر للحدود القانونية، وبالتالي من الضروري أن يكون هناك قصد جنائي ونية مُتعمدة للقيام بالفعل الجرمي لكي يتم اعتباره جريمة. من خلال القصد الجنائي يمكن إسناد المسؤولية الجنائية للأفعال الجرمية إلى المرتكبين. وعلى الرغم من أنه قد يكون من الصعب إثبات القصد الجنائي، إلا أنه ليس من المستحيل الاستدلال عليه، كما يمكن استنتاج القصد الجنائي من خلال الآثار الخارجية للجريمة وكيفية ارتكابها. مع ذلك، يجب أن يتبع النظام القانوني مبدأ "البراءة حتى يُثبت العكس"، حيث لا يمكن إدانة المتهم ما لم يتم إثبات القصد الجنائي بشكل مقنع ومنطقي وفقًا للأدلة المتاحة.
