نظــــــــــام الصحــــــــــــــــــة والسلامـــــــة المهنيــــــــــــــة للعامــل فـــــــــــــــــي القانون الجزائـــــــــــــــــــــــــــــــري

Abstract

تهدف هذه الدراسة إلى إبراز مدى أهمية تطبيق برنامج نظام الصحة والسلامة المهنية في المؤسسات والمنشآت ، خاصة ذات الطابع الصناعي ،ومدى تطبيق العمال للإجراءات التي تسنها الدولة التي نشرتها عبر النصوص القانونية والمراسيم ،من أجل بسط جانب من الأريحية للعمال أثناء تأدية مهامهم من الناحية الجسدية والنفسية لأن المورد البشري هو محرك كل مؤسسة ، ولقد ركزنا في بحثنا هذا على هذا الجانب من خلال معرفة البرامج والسياسة المتبعة من طرف الدولة من أجل تطبيق نظام الصحة والسلامة المهنية في المؤسسات خاصة الصناعية. ولقد أولى المشرع الجزائري أهمية كبيرة للعامل في القانون الجزائري من خلال بسط لجان الوقاية تقوم بمراقبة برامج نظام الصحة والسلامة ومدى وملاءمتها للعمال في بيئة العملوأيضا مراقبة المؤسسات وكيفية تطبيقها لبرامج الصحة والسلامة المهنية في أرض الواقع. فهذه المذكرة تعالج موضوع الصحة والسلامة من الناحية التطبيقية ومدى التزام المؤسسات بتطبيق القوانين الخاصة بها من أجل تحسين أداء العاملين. This study aims to highlight the importance of applying the occupational health and safety system program in institutions and establishments, especially of an industrial nature, and the extent to which workers apply the procedures launched by the state by publishing them through legal texts and decrees in order to extend the aspect of comfort to workers while performing their tasks from a physical and psychological point of view because the resource The human being is the engine of every institution, and we have focused in our research on this aspect by knowing the programs and policy followed by the state in order to implement the occupational health and safety system in private industrial institutions, and the Algerian legislator has attached great importance to the worker in Algerian law through the extension of prevention committees In order to monitor health and safety system programs and their suitability with workers in the work environment, as well as monitoring institutions and how they apply occupational health and safety programs on the ground.This memorandum deals with the issue of health and safety from an applied point of view and the extent to which institutions are committed to applying their laws in order to improve the performance of workers.
