المسؤولية القانونية للإدارة عن نشاط موظفي الإدارة

Abstract

يعتبر العنصر البشري هو الأساس المحرك للنشاط الإداري داخل المرفق العمومي والمتمثل في مختلف الإدارات العمومية، وهذه الإدارات تؤدي المهام المنوطة بها من خلال هذا العنصر البشري، الأمر الذي قد ينجر عنه حدوث تجاوزات أو أفعال غير متعمدة تحول دون الوصول إلى إعطاء الأفراد الذين يقصدون هذه الإدارات لحقوقهم، لذا أوجد المشرع المسؤولية عن النشاط الإداري من أجل توفير أقصى درجات الحماية للموظف أو الأفراد الذين لهم علاقة مباشرة بنشاط الإدارة، وهدفت هذه الدراسة إلى التعريف بهذه المسؤولية المتعلقة بنشاط موظفي الإدارة وذلك بالتعريف بمسؤولية الإدارة عن النشاط الذي تؤديه إضافة إلى ابراز الآثار القانونية التي تنتج عن الأخطاء التي يقع فيها الموظف الإداري من خلال ابراز الالتزامات التي تقع على عاتق هذه الإدارة، واعتمدنا المنهج الوصفي التحليلي باعتباره الأنسب لتحليل وتبسيط المفاهيم المتعلقة بالمسؤولية عن نشاط الإدارة وعن الآثار المترتبة على أخطاء الموظف داخلها، وقد توصلت هذه الدراسة إلى ان المشرع الجزائري من أجل توفير أقصى دجات الحماية للموظف والأفراد الذين يتعاملون مع الإدارة أوجد المسؤولية عن النشاط الإداري والمسؤولية عن الأخطاء التي تقع من طرف الإدارة.

The humanelementis the driving force behind administrative activitywithin public institutions, namelyvarious public administrations. These administrations carry out theirassignedtasksthroughhumanresources, whichcansometimesresult in misconduct or unintentional actions thathinderindividualsfromreceivingtheirrightful services. Therefore, the legislator has established the concept of liability for administrative activity in order to provide the highestlevel of protection for bothemployees and individualswhodirectlyinteract with administrative bodies. This studyaims to definethis type of liabilityrelated to the actions of administrative employees by clarifying the administration’sresponsibility for the activitiesit carries out, as well as highlighting the legalconsequencesresultingfrom the mistakescommitted by administrative employees. This includesidentifying the obligations thatfallupon the administration. The studyadopts a descriptive and analyticalmethodology, as itis best suited for analyzing and simplifying the concepts related to administrative activityliability and the consequences of employeeerrors. The studyconcludesthat, in order to provide the highestlevel of protection for employees and individualsdealing with the administration, the Algerian legislator has introducedliability for administrative activity and for mistakescommitted by the administration.
