المسؤولية الجنائية عن جريمة التعذيب - دراسة مقارنة في الفقه الإسلامي و القانون الوضعي

Abstract

تناولت المذكرة دراسة موضوع المسؤولية الجنائية عن جريمة التعذيب دراسة مقارنة في الفقه الإسلامي و القانون الوضعي, وقد تضمنت في البداية شرحًا لمفهوم المسؤولية الجنائية و جريمة التعذيب, ثم تطرقت للأسس الشرعية لحظر التعذيب بالاعتماد على النصوص الشرعية من القرآن الكريم والسنة النبوية وبعض الآراء الفقهية,كما تعرض البحث للأسس القانونية التي تحظر التعذيب وتجرمه وذلك من خلال الاتفاقيات الدولية و القوانين الوطنية, وكذا المواثيق الإقليمية في مجال حماية حقوق الإنسان خاصة حقه في عدم التعرض للتعذيب, وختمت الموضوع بأهم النتائج التي توصلت إليها من خلال البحث. The study of the subject of criminal responsibility for the crime of torture dealt with a comparative study in Islamic jurisprudence and positive law. It initially included an explanation of the concept of criminal responsibility and the crime of torture. Then, it addressed the legal foundations of the prohibition of torture by relying on the legal texts of the Holy Qur’an, the Sunnah of the Prophet, and some jurisprudential opinions. It also presented Researching the legal foundations that prohibit and criminalize torture through international agreements and national laws, as well as regional conventions in the field of protecting human rights, especially the right not to be subjected to torture, and I concluded the topic with the most important results I reached through the research.
