Abstract

The researcher " Hum Marriage and Divorce in Islamic Legislation ", where we touched on the study of initial concepts of Hum Marriage in Islamic Legislation. What is Hum Marriage and its sections in Islamic Fiqh through the doctrines of Imams. Then we dealt with the recent study of Hadith of the prophet Mohammed, peace and blessings of Allah be upon him " Three matters done in seriousness are serious and their being done jokingly are serious; marriage, divorce and taking back a wife. " We were also introduced to hum marriage and the sayings of scolars on it as well as for hum divorce, where we dealt with the general judgments relating to it and we touched on a study related to Hum Divorce for its importance, and the sayings of scholars regarding this study. Finally, we concluded our research with some of our findingsThe use of the descriptive approach and analytical method in the study, is marriage and divorce come from the hazel ?, and we have reached the words of the majority of scholars that it falls as a joke in marriage is very serious as well as humor in divorce.
