صور الاعذار القانونية في التشريع الجزائري

Abstract

الاعذار القانونية هي حالات نص عليها القانون حصرا، وهي نتقسم الى اعذار مخففة للعقوبة واعذار معفية من العقوبة وتكون ملزمة للقاضي في تطبيقها، عكس الظروف القانونية التي ينضر القاضي فيها ويقدرها حسب المعطيات المتاحة امامه، ولقد رأينا ان الاعذار القانونية المخففة والظروف المخففة لا يختلفان من حيث التأثير على العقوبة فكلاهما يخفف العقوبة بالنزول عن حدها المقرر قانونا، الا ان الاعذار القانونية والظروف القانونية لا تمحو الجريمة ولا المسؤولية الجنائية بل تأثر فقط على الجزاء Legal excuses are cases provided for exclusively by law and are divided into mitigating excuses and exempt excuses that are binding on the judge in their application.
