سد الذرائع وتطبيقاتها في الأحوال الشخصية

Abstract

تناول هذا البحث قاعدة مهمة من قواعد الشريعة الإسلامية وهي قاعدة سد الذرائع ومدى إعمالها في مجال من أهم مجالات الفقه وهو الأحوال الشخصية , فجاء تحت عنوان " سد الذرائع وتطبيقاتها في الأحوال الشخصية ",فكانت إشكاليته الرئيسية هي : ما هي آثار تطبيقات قاعدة سد الذرائع في الأحوال الشخصية؟ و للإجابة على هذه الإشكالية قسم البحث إلى ثلاثة فصول, فكان الفصل التمهيدي حول مفهوم القاعدة الفقهية والقاعدة الأصولية و الفرق بينهما في المبحث الأول ,ثم مفهوم الأحوال الشخصية وآراء العلماء في المصطلح في المبحث الثاني , ثم تلاه الفصل الأول لبيان حكم سد الذرائع و أركانها في المبحث الأول, ثم أقسامها وشروط سدها في المبحث الثاني , ليختتم بفصل ثان تطبيقي تضمن تطبيقات سد الذرائع في الأحوال الشخصية فكانت التطبيقات في الخطبة والنكاح في المبحث الأول ,ثم تطبيقات في الطلاق والعدة في المبحث الثاني, ثم تطبيقات في الإيلاء و الوصية والميراث. This research dealt with an important rule of Islamic Sharia rules, which is the rule of blocking excuses and the extent of its implementation in one of the most important areas of jurisprudence, which is the personal status. It came under the title “Blocking the excuses and their applications in personal cases.” His main problem was: What are the effects of the applications of the rule of blocking excuses in Personal Status? In order to answer this problem, the research was divided into three chapters. The introductory chapter was about the concept of the jurisprudential rule and the fundamental rule and the difference between them in the first topic, then the concept of personal status and the opinions of scholars on the term in the second topic. Then the first chapter was followed to explain the rule of blocking the excuses and its pillars in the first topic, then its sections and conditions for closing them in the second topic, to conclude with a second applied chapter that included the applications of blocking the excuses in personal cases. then applications in devotion , will and inheritance.
