Abstract

نظرا للتغيرات الحاصلة في العالم في كافة النواحي والتي دفعت بالمشرع إلى مواكبة تلك التطورات من الناحية التشريعية، استحدث المشرع الجزائري محاكم تجارية متخصصة وعمل على تنظيمها وسيرها بموجب القانون رقم 22-13، المعدل والمتمم للقانون رقم 08-09 المتضمن قانون الإجراءات المدنية والإدارية. وقد هدفت هذه الدراسة إلى تسليط الضوء على دورها في تسوية المنازعات التجارية، كتأكيد لطبيعتها الخاصة التي تفرض آليات مرنة للتعامل مع تلك المنازعات، ولاسيما متطلبات بيئة الأعمال وتحفيز الاستثمار.

Regarding the changes occurring in the world across all aspects, which have prompted the legislator to keep pace with these developments from a legislative standpoint, the Algerian legislator has established specialized commercial courts and has worked on organizing and regulating their proceedings under Law No. 22-13, amending and completing Law No. 08-09 containing the Civil and Administrative Procedure Act ." This study aimed to shed light on their role in settling commercial litigation , as a confirmation of their special nature that necessitates flexible mechanisms for dealing with such disputes, particularly the requirements of the business environment and boosting investment."
