Abstract

This research includes the study of rules that are relating to the guarantee and their application.These rules are very useful, very important and they are showing the leniency and comprehensiveness of the Islamic legislation.This study aims to determine the elements of these rule and clarify its importance in Islamic legislation and show the extent of their legitimacy. It deals with the explanation of these rules and mentions some sources of some of these rules of the the four schools of Islamic jurisprudence and the way of its application. These rules need to be studied in depth and detailed, because they contain a lot of provisions on the transaction of people that concern them primarily.
