الاجتهاد الاستثنائي عند المالكية وتطبيقاته في باب المعاوضات المالية

Abstract

تناولتْ هذه المذكرة دراسة حول: الإجتهاد الاستثنائي عند المالكية وتطبيقاته في باب المعاوضات المالية، فعرفت الاجتهاد الاستثنائي وبينت جدّة ألفاظه ومبانه مع اقدمية أحكامه ومعانيه، وأظهرت أهميته وحصرت مجاله وسردت أدلته من القرآن والسنّة وعمل سلف الأمّة، وجمعت ضوابط الاجتهاد الاستثنائي حتى ينضبط ولا يتسيب وينتظم ولا يتشعب. وخُتمت الدراسة ببيان الاجتهاد الاستثنائي في تطبيقات فقهية عملية في باب المعاوضات المالية على أصول السادة المالكية وتوزعت بين عقود تجارية وعقود صناعية وعقود زارعيه وهي اصول الحرف على الإطلاق التي ترجع اليها المعاملات المالية تملكا وتكسبا، فأبانت متانة أصول المذهب المالكي وصحتها وسعة فروعه واستيعابها، ومن كانت أصوله أصح كان بناءه أقوى. This memorandum dealt with a study about: The extraordinary Diligence to the Malikis and it's applications in the section on financial compensation. I knew the extraordinary Diligence and demonstrated the seriousness of its words and structures, along with the antiquity of its rulings and meanings. It showed it's importance, defined it's scope , and listed it's evidence from the Qur’an and the Sunnah, and the work of the nation's predecessors. The controls for this Diligence have been collected so that it's disciplined, and does not wander , is organized, and doesn't diverge. This study concluded with an explanation of practical jurisprudential applications in the chapter on bargaining over the assets of the Maliki masters, which were distributed among commercial contracts, industrial contracts, and agricultural contracts ,They are the fundamentals of the profession in general, to which financial transactions, ownership and earnings, are traced
