العقوبات التأديبية الواقعة على الموظف العام دراسة مقارنة بين - الفقه الإسلامي والقانون الجزائري -

Abstract

تعالج هذه الدراسة موضوعا هاما من مواضيع الوظيفة العامة تتمثل في تأديب الموظف تحت عنوان:" العقوبات التأديبية الواقعة على الموظف العام دراسة مقارنة ". حاولت التطرق في هذه الدراسة بداية بإبراز العقوبات التأديبية وتصنيفاتها وإجراءاتها والضمانات المقررة لحماية الموظف، وُصُولاً إلى كيفية رفع الدعاوى وطرق الطعن فيها، فالمشرع الجزائري وضع جملة من القواعد لاخداذها ومراعاتها، و لضمان حقوق الموظف العام وجب عليه القيام برفع الدعاوى أمام المحكمة الإدارية للمطالبة بحقه وحُايته من تعسف الإدارة. وبهذا العقوبات التأديبية تَ عُدُ بمثابة الجزاء الذي يَمسُُ الموظف العام في حياته المهنية عند ارتكابه بخطأ مهني أو في حالة الإخلال بواجباته المهنية، فَ تُ عَدْ وسيلة السلطة الإدارية لضمان واحترام القواعد القانونية و تحقيق السير المنتظم والفعال للمرافق العامة.The public employee under the title: "Disciplinary penalties imposed on the public employee, a comparative study." In this study, I tried to address the beginning by highlighting the disciplinary sanctions, their classifications, procedures, and guarantees. Decided to protect the employee, down to how to file lawsuits and ways to challenge them, the Algerian legislator has set a number of rules to be taken and observed, and to ensure the rights of the employee, he must file lawsuits before. The Administrative Court to claim his right and protect him from the abuse of the administration. Thus, disciplinary penalties are considered as the penalty that affects the public employee in his professional life when he commits a professional error or in the event of a breach of his professional duties, so it is considered a means of the administrative authority to ensure and respect the legal rules and achieve the regular and effective functioning of public utilities.
