المسؤولية المدنية للعون الاقتصادي في ظل التشريع الجزائري

Abstract

إن التطور العلمي والتكنولوجي أدى الى تنوع مبهر في عرض السلع والخدمات من العون الاقتصادي الذي له قدرة في الترويج باستعماله جميع الطرق والاساليب بغية تحقيق المزيد من الارباح دون المراعاة لما قد يلحق المستهلك من ضرر، وهذا ما جعل المشرع الجزائري يتدخللإعادة التوازن لهذه العلاقة وتحميل العون الاقتصادي مسؤوليته من خلال الخطأ كأساس تقليدي والذي أثبت عدم قدرته في تعويض وتحقيق الحماية الكافية للمستهلك ماأدى الى التفكير في أساس قانوني مستحدث كنظرية المخاطر والتي حققت نجاعتها في ظل الانفتاح الاقتصادي . كما سعى المشرع إلى وضع ضوابط وقواعد قانونية توجب على العون الاقتصادي التزامات وتفرض عليه جزاءات بعد توفر مجموعة من الشروط لقيام المسؤولية المدنية كما انه تحقيقا لمبدأ الانصاف والعدالة ترك للعون الاقتصادي الحق في نفي أو دفع المسؤولية الملقاة على عاتقه بكل الاساليب والوسائل المتاحة.

Scientific and technological advancements have led to a remarkable diversity in the supply of goods and services, with economic assistance being a powerful tool used to promote products and increase profits without considering potential harm to consumers. In response, Algerian legislators have intervened to restore balance in this relationship and hold economic assistance accountable. Traditional principles and rules have proven inadequate in compensating for and achieving sufficient consumer protection, leading to the development of a new legal basis, such as the theory of risk. This theory has proven effective in the context of economic openness. The legislator has also sought to establish legal controls and rules that impose obligations on economic assistance and subject them to penalties after meeting a set of conditions for civil liability. Additionally, to uphold the principles of fairness and justice, economic assistance has the right to deny or transfer the responsibility imposed on them using all available methods and means.
