عوارض المسار المهني للموظف العام في القانون الجزائري

Abstract

تعتبر الوظيفة العامة نظاما قانونيا قائما، تحكمه عديد المبادئ، فضلا عن مختلف الأحكام المقررة أو الناظمة للعلاقات القانونية، وعلى هذا الأساس فقد نص قانون الوظيفة العمومية على الوضعيات الأساسية للموظف وتناول التنظيم تطبيقات ذلك، حيث قد تتخلل المسار الوظيفي بعض الحالات أو الأوضاع وهو ما عبرنا عنه بالعوارض بالنظر لطبيعتها و آثارها، هذه الأخيرة قد تؤثر على المسار الوظيفي بشكل إيجابي أو بشكل سلبي، خصوصا على الحقوق والواجبات التي أقرها القانون للموظف العمومي. وعليه، أبرزنا من خلال موضوعنا هذه العوارض نبيانا وتوصيفا لها و لمختلف الآثار القانونية المترتبة عنها.

The public employment is a legal system governed by many principles, in addition to various laws and regulations governing legal relationships. Based on this, the Public Employment Law stipulates the basic situations of the employee and the application of the regulations. The job path may encounter some cases or situations that we referred to as "complications," which may affect the career path positively or negatively, especially regarding the rights and duties that the law grants to the public employee. Therefore, we highlighted through our topic these complications by explanation and description, as well as the various legal effects resulting from them.
