حماية اختراعات العامل بين قانون العمل وقانون براءات الإختراع : دراسة على ضوء القانون الجزائري

Abstract

يعد النظام القانوني لحقوق اختراع العمال من القضايا المهمة على المستوى الوطني والدولي ونجد أن حقوق العامل في اختراعاته المكتسبة فيما يتعلق بعقد العمل يتنازعها قانون العمل وقانون براءات الاختراع ، نجد أن المشرع الجزائري لم ينظم قواعد وأسس حماية اختراعات العامل ضمن قانون 90-11 في عقد العمل يحث أن العامل الطرف الضعيف في عقد العمل. على عكس التشريع المقارن يهدف إلى تحقيق التوازن بين أحكام قانون العمل ، يحث نظم تدابير حماية اختراعات العامل في عقد العمل ، لذلك فقد اهتم التشريع المقارن بتضمين اختراعات العمال في قانون العمل و قانون براءات الاختراع ، وذلك لتوفير أقصى حماية ممكنـة لاختراعات العامـل كونـه الطرف الضعيف في عقد العمل من قبل صاحب العمل صاحب النفـوذ والمركـز الاقتـصادي القوي .

The legal system of workers' inventions is an important issue at the national and international levels. We find that the rights of workers in their inventions acquired in relation to the employment contract are disputed by the Labour Code and the Patent Act. Algerian legislation has not regulated the rules and principles for the protection of the inventions of workers in the 90-11 Act. Contrary to comparative legislation aimed at balancing the provisions of the Labour Code s inventions in the contract of employment, Comparative legislation has therefore been interested in including workers' inventions in the Labour Code and the Patent Act to provide maximum possible protection for the inventions of the worker as the vulnerable party to the employment contract by the enforcing employer and the strong quotative position.
